Chapter 7 Bankruptcy

A form of consumer or personal bankruptcy, Chapter 7 bankruptcy is also sometimes called a "fresh start" bankruptcy. This is because some or all of your debt may be discharged in order for you to regain control of your financial situation.

  • Chapter 7 begins with us compiling a list of all your outstanding debts. All creditors receive a notice that the bankruptcy has been filed and are given an opportunity to object to the bankruptcy or to file claims to retrieve collateral under security interests they hold. An experienced bankruptcy attorney such as myself can help determine which debts are subject to liens or not dischargeable and may also identify which creditor's claims may not, in actuality, be valid.
  • Typically, a Chapter 7 case begins with the filing of a petition in bankruptcy court, includes your attendance at a meeting of your creditors and may result in the subsequent discharge of your debts by the bankruptcy court.
  • Since not all debt may be dischargeable, we discuss with you the options you have for filing bankruptcy. In some cases, a combination of Chapter 7 and Chapter 13 bankruptcies may be appropriate.
