12 Factors That Determine Child Custody
Under Michigan state law, there are 12 factors used to determine custody, including:
- Which parent provides greater love and affection and has a greater emotional bond with the child
- Which parent has the greater capacity to care for the child
- Which parent is best able to provide for child's monetary needs
- Which parent has a history of providing the child with a stable and safe living environment
- In which parent's custody will the family unit stay most intact
- Does either parent have a history of immoral action such as involvement in an extra marital affair, physical or verbal abuse or substance abuse
- What is the condition of each parents' mental and physical health
- Which parent can best provide a strong home, school, and community life for the child
- With which parent does the child prefer to reside
- Is the parent willing and able to facilitate and encourage a continuing relationship between the child and the other parent
- Does either parent have a history of domestic violence
- Are there any other factors that should be considered by the court? These factors may regard a child's special needs, the existence of new spouses and the inability of parent to meet court ordered visitation responsibilities.
